How Accountability Act scholarships works

What it isA scholarship program created by the Alabama Accountability Act of 2013. Donors give to approved scholarship granting organizations (SGOs) and claim an Alabama tax credit, and the SGOs award the scholarships. It is a separate program from the CHOOSE Act. [1][2]
What you getUp to $10,000 per student per academic year, toward tuition and mandatory fees at a qualifying school. A lump sum or block grant paid to a school does not count as a scholarship. [2]
Who qualifiesA new student whose family income for the calendar year before is no more than 250% of the federal poverty level, who was eligible to attend public school the semester before or is starting school in Alabama for the first time, and who lives in Alabama. The SGO re-checks income every other year, and a student who has had a scholarship stays eligible until family income goes above 350%. [2]
Students with unique needsThe law also defines eligible students with unique needs, such as a current IEP or 504 plan, who attended a school in Alabama the year before and are not enrolled in a public school. [2]
How full it isDonor tax credits are capped at $40 million a year. The cap rises by $10 million when credits pass 90% of it in three of four years, up to $60 million. The Alabama Opportunity Scholarship Fund, one of the eight SGOs, says it will not offer new awards for 2026-27 because of funding. [2][7]
Which schoolsPrivate schools that tell the Alabama Department of Revenue they intend to take part and meet the law's accreditation rules. The department's list dated August 10, 2026 names 163 schools, and it keeps a separate list of schools removed from the program. [2][4][5]
With the CHOOSE ActNot at the same time. The CHOOSE Act excludes students receiving Accountability Act scholarship funds or tax credits. [6]
